Re: AAARRRGGGGHHHHHH!!!!!!!

Sad thing is, we little people need lawyers to protect us and even out the playing field, but then we have crap like this that's allowed to happen. All for a buck.

And just to make sure no one says anything mean about the poor guy on any internet forum:

This one will certainly end up in Federal Court and maybe all the way to the Supremes .

These lawsuits are like ice bergs. It's what you don't see below the surface that is 100 times larger than what is on the surface. The real problem is all the ones that are settled out of court because the defendents see this crazy award. Most of the suits are never seen by a jury and are defended until the plaintiff finally realizes they don't have a case or the defendent settles to make the suit go away.

Re: AAARRRGGGGHHHHHH!!!!!!!

That's just disgusting. Hey - if yer gonna fly in ANYTHING you take a chance, especially a 42 year old plane. I don't know. I keep reading articles in AOPA pilot that lawyers AREN'T the reason flying costs so much. Really ??!! :^o #-o Well, I'd say definitely a contributing factor for sure !

Yep, it had to be a faulty carburetor. There is no other possible explanation!

I won't say what I am thinking about people who bring this type of law suite and lawyers who represent them. Lets just say it is not nice. Even if Lycoming prevails in appeals court we all pay the cost.

Re: AAARRRGGGGHHHHHH!!!!!!!

I could tell you all some doozies...I see them quite frequently...will make your blood boil.

Remeber the Cory Lidle, Cirrus crash in NY a few years back? I was the underwriter on that one...simply put...pilot error...they tried to make a 180 degree VFR turn (with the wind) from the middle of the corridor...could not make the turn without a stall and hit the building.

Parties named in the various lawsuits: Avidyne, Garmin, Cirrus, TCM, the flight school, the instructors estate, and Cory Lidle's estate.

We just wrote a check for the policy limits...

Why so many named in the suit? Cory's contract with the Yankees stated that if he died while operating an aircraft his contract was void...no benefits paid to the family. His life insurance policy also had a pilot exclusion (this is fairly typical) that voids the policy in the event he died while operating the aircraft....his wife was left with nothing if it was proven he was operating.

Shotgun approach on the lawsuit...name enough companies and a little settlement from each adds up to a lot of money. It is cheaper for them to settle out of court than to pay to defend themselves and roll the dice with the courts.

Welcome to the litigious society as we know it...this stuff happens all the time.
