Maybe you could prove that you didn't spot the animal from the air. But that would be hard, unless you flew in before daylight. I think the better practice is to wait until the next day to hunt.

I have had this conversation with various rangers. I don't have to prove that I didn't spot animals to hunt with the plane. FWP has to prove I did. They may certainly come up to you and have a chat but they would do this anyways, it's their job.
