NV State Resolution Banning Experimental Aircraft

There is a resolution comming up Before the Nevada State to ban experimental aircraft at the North Las Vegas Airport.

Nevada Senate Joint Resolution 3 (SJR3) is being proposed to the Senate Committee on Energy, Infrastructure and Transportation on Tuesday, February 17 at 8:00 am Room 2135, of the Nevada Legislature.

SENATE JOINT RESOLUTION—Urging Congress to authorize
the Clark County Department of Aviation to ban flights of
experimental homebuilt aircraft to and from the North Las
Vegas Airport.
Legislative Counsel’s Digest:
1 Federal law provides that the United States Government has exclusive
2 sovereignty of airspace of the United States and requires the Administrator of the
3 Federal Aviation Administration to prescribe regulations on the flight of aircraft to
4 prevent collisions between aircraft and to protect persons and property on the
5 ground. (49 U.S.C. § 40103) This resolution expresses the concerns of the
6 Legislature regarding the safety of flights of experimental homebuilt aircraft to and
7 from the North Las Vegas Airport and urges Congress to enact legislation
8 authorizing the Clark County Department of Aviation to ban flights of experimental
9 homebuilt aircraft to and from the North Las Vegas Airport.
1 WHEREAS, The expansion of urban areas in Clark County
2 increasingly places homes and neighborhoods directly in the flight
3 paths of aircraft flying to and from the North Las Vegas Airport;
4 and
5 WHEREAS, Flights of experimental homebuilt aircraft to and
6 from the North Las Vegas Airport are increasingly common; and

1 WHEREAS, Experimental homebuilt aircraft have higher
2 accident rates than other types of aircraft and accounted for more
3 than 12 percent of airplane accidents nationwide in 2007; and
4 WHEREAS, Experimental homebuilt aircraft have been involved
5 in more than 20 accidents in Clark County since 2003; and
6 WHEREAS, Crashes involving experimental homebuilt aircraft
7 flying from the North Las Vegas Airport resulted in the deaths of
8 several persons on the ground in 2008; and
9 WHEREAS, The safety of persons who live near the North Las
10 Vegas Airport is of the highest concern to the people of this State;
11 and
12 WHEREAS, The Clark County Department of Aviation cannot
13 regulate the flights of experimental homebuilt aircraft to and from
14 the North Las Vegas Airport because federal law provides the
15 United States Government with exclusive sovereignty of airspace in
16 the United States; now, therefore, be it
17 RESOLVED BY THE SENATE AND ASSEMBLY OF THE STATE OF
18 NEVADA, JOINTLY, That the Nevada Legislature expresses serious
19 concerns regarding the safety of allowing flights of experimental
20 homebuilt aircraft to and from the North Las Vegas Airport; and be
21 it further
22 RESOLVED, That the Nevada Legislature urges the Congress of
23 the United States to enact legislation authorizing the Clark County
24 Department of Aviation to ban flights of experimental homebuilt
25 aircraft to and from the North Las Vegas Airport; and be it further
26 RESOLVED, That the Secretary of the Senate prepare and
27 transmit a copy of this resolution to the President of the United
28 States, the Vice President of the United States as the presiding
29 officer of the United States Senate, the Speaker of the House of
30 Representatives and each member of the Nevada Congressional
31 Delegation; and be it further
32 RESOLVED, That this resolution becomes effective upon
33 passage.

North Las Vegas airport vs expementals

The North Las Vegas airport is run by the Clark County airport board. The crash of a experimental in to a house months ago didn't help anything .
About a week after the experimental a Navajo went into another house near NLV airport. Nellis AFB doesn't take any of the crap. The citi zens (?) are wanting to close down airports wherever.
About a year back the airlines at McCarian started turning north over the northwest part of town (Las Vegas) and the homeowners started yelling about everything. Thank goodness I'm at the Boulder City airport southeast
of Las Vegas . Recently The Clark county airport board wants to take over
Boulder City(61b) -no thanks. I'll move to AZ. or Utah if they take over 61b.

From the looks of the number of houses for sale on craigslist in Las Vegas, the herd might be getting culled just a tad. Probably too late to help the airports, though.

Legislative posturing. It is simply a resolution asking Congress to blah blah blah. Not a bill to become law. If they were to attempt to actually pass a law instead of a letter to Congress I think it would be unprecedented and would likely be overridden in federal court.

That said it wouldn't hurt to defeat it before it comes to that :wink: OTOH if it passes it will pacify the whiners who are likely too stupid to realize how much of a waste of time the whole exercise was.

Progress Report on Call to Action Regarding Nevada Airspace Proposal:

Please stand down for now, pending new collaboration for solution

Amid vocal protest from the state's aviation community, the two Nevada state legislators who submitted a resolution calling for county-government jurisdiction over national airspace have agreed to suspend their legislative effort and instead work with local general-aviation groups on airport-safety issues there. Consequently, a hearing on the proposed legislation slated for Feb. 17 has been postponed.

In light of this favorable development, EAA asks members to defer any further participation in the Call to Action letter-writing campaign that EAA issued Thursday. Commending the hundreds of members who responded, EAA is now asking members to stand down and await the outcome of talks among these Nevada state legislators, state and county aviation officials, local EAA chapters, AOPA, and the Clark County Aviation Association (CCAA).

"We're hopeful that the local collaborative effort will yield a better understanding of the safety issues at North Las Vegas Airport. We're looking for real solutions that neither jeopardize our federal airspace-management standards nor scapegoat any particular category or class of general-aviation operations," said Earl Lawrence, EAA vice president of regulatory affairs.

The lawmakers' proposed resolution stemmed from controversial action taken last year by the Clark County, Nevada director of aviation, Randall H. Walker. In the wake of recent fatal airplane crashes originating from North Las Vegas Airport, Walker successfully petitioned the Clark County Board of Commissioners to urge state lawmakers to push Congress for local airspace sovereignty. One of the crashes involved a Velocity amateur-built aircraft that struck a house shortly after takeoff and resulted in the death of the pilot and two people on the ground. In the immediate aftermath, Walker called on FAA and Congress to allow metropolitan airports to bar "high risk" operations at their facilities, including amateur-built aircraft and flight instruction.

Since then, EAA has been supporting the grassroots efforts of the CCAA and local general-aviation groups in mounting opposition and pointing out several flight safety misconceptions in Walker's and the Clark County Board's argument. One "apples and oranges" example is their claim that since 2003 there have been 20 accidents involving amateur-built aircraft within Clark County. But looking only at VGT, three accidents involving amateur-built aircraft have occurred in the past 26 years, while during that same time more than 50 accidents involving type-certificated aircraft occurred.

EAA's Washington representative, Doug Macnair, has also been in discussions with members of the U.S. House and Senate, warning of the potential cascading effect that would result by allowing local airport managers in other urban areas to control their airspace.
