Getting ready to head south. Transponder waiver???

Getting ready to head south. Transponder waiver???

I recently purchased a Citabria. I am planning on flying it from AK to UT for the winter.
I have crossed the border many times but always had a transponder.
The Citabria has no transponder.

All of the links I can find for transponder waivers go nowhere.

Does anybody have any Reliable information on what I need to do to get a waiver?

You don't need a transponder in Canada... Do you need one in the US? Or why do you need a waiver?

The FARs require pilots to file and activate a flight plan for all flights crossing the U.S.–Canada border, including flights “with no landing”. Pilots must communicate with Air Traffic Services (ATS) at the time of the border crossing and squawk an assigned discrete transponder code (FAR 91.707).

Aircraft are to be equipped with a Mode C transponder when operating in Canadian Class A, B, C, D and E
airspace, as specified in the DAH (TP 1820E), which is available from NAV CANADA (CAR 601.03).



601.02 (1) The class of any controlled airspace of a type referred to in subsection 601.01(1) is one of the following, as specified in the Designated Airspace Handbook:

(a) Class A;

(b) Class B;

(c) Class C;

(d) Class D;

(e) Class E;

(f) Class F Special Use Restricted; or

(g) Class F Special Use Advisory.

(2) The class of any uncontrolled airspace of a type referred to in subsection 601.01(2) is one of the following, as specified in the Designated Airspace Handbook:

(a) Class G;

(b) Class F Special Use Restricted; or

(c) Class F Special Use Advisory.

Transponder Airspace

601.03 Transponder airspace consists of

(a) all Class A, B and C airspace as specified in the Designated Airspace Handbook; and

(b) any Class D or E airspace specified as transponder airspace in the Designated Airspace Handbook.

Huh. I guess maybe I do need to brush up. Or maybe you don't know. I guess all my training in a C150 and all the flying I do with my C180, both with no transponders didn't teach me a thing...
Yes class C is required to have a transponder, but you can call ahead and they'll allow you in without. Not that many airports are class C. There is pretty much no class B in Canada that I can access with my 180. And I don't know of any Class D that requires transponder, but I'm sure there's a couple. In any case, a phone call clears that up. And in any case, it is very simple to fly through Canada not stop in Class C. 99% of flying here does not require a transponder... Thanks though.

But good to know about the crossing thing. I guess I'll need a waiver when we cross in Alaska next year. So I'll be watching this.

Found it:

There are two application pages:

TSA Waiver Request Form- U.S./Canada Border Crossing Without Transponder

and

TSA Waiver Request Form- Security Statement.

The only useful reference shown is a phone number, but I called it and it obviously doesn't go to the right place anymore, so I'm not posting it here. Sorry not to be more helpful.

I got one years ago as well. Seemed like it took a couple of weeks time. When I filed to cross, the genius at flight service, a contract agency, gave me a squawk code anyway even after explaining that I was on a waiver. Never saw any F16's so I guess all was well.

Yes, you need a transponder waiver to cross the US border. The following link will take you to the page where you begin the process: https://waivers.faa.gov/app/te_pages.p_login Like all things with the US Customs and Border Patrol, when they catch you doing anything that they don't like, they assess a big fine and then start talking about jail time. You don't want any of that. So go through the process and be prepared.
