A bill adding aviation related activities to the recreational use statutes has been introduced in the SD legislature.
Another bill was introduced ending the double taxation issue related to building and registration of homebuilt aircraft.
I will follow the progress of the bills and provide the updates as they become available.

Thanks for the efforts. NM and AZ just passed similar liability legislation last year. RAF was a great resource to us and I would recommend that you contact them if you haven't already.
If we are to see new strips open in the future (instead of being closed), it is most likely that it will happen on private land. That said, legislation is critical to give land owners protection from ambulance chasing attorneys looking for an easy score.

We have a bill filed in Oklahoma for the upcoming session (the session starts in two weeks) to add recreational aviation activities to the same category as property owner liability exclusions as hunting and fishing. I have been coordinateing with the RAF and others and will ask for help when the time is right to email legislators in support.

Update.
I received this report from the president of the SD Pilot Assoc.
"HB1212 concerning "aviation activity" as a recreational use did just fine in the hearing on Monday, Feb 6. The bill was passed unanimously by the Judiciary Committee (13 aye and 0 nay). Part of the success of the bill's passage was two pilots testifying on behalf of the bill. HB1212 also passed unanimously in the full House (67 aye and 0 nay) Feb 7."
It still faces the senate.
Thursday we try for the sales tax exemption on parts for homebuilt aircraft. Update to come following the hearing.
