Something to be aware of when making videos

I used to follow a certain user on YouTube who was posting some awesome Rans Coyote videos. To my shock and dismay they had all been removed by the user. I emailed him to ask why. This was his response:
I got tired of all the [BS] copyright claims for the music tracks. Google really screwed youtube when the advertising started. All the petty record companies came out of the woodwork with their claims against everyone's music tracks.

With that I decided to pull all the vids and repost them on another system.

They definitely won't be posted on youtube again. I will however provide a link at some point when I get them uploaded.


Not sure what Vimeo's stance on this is but just thought I'd bring it up for everyone who puts their videos to music.

I got a message about copy right music too. Just ignored it. Kinda makes me think the musicians deserve the music pirates. The music I use, I bought, and now they want me to pay again to use it with my video. f#@$ them.

So what was the request? I believe, if a band covers a song written by someone else, the cost is $.04 for every album sold with that song on it.
I'm with Rob on this one. If I purchased the music, my wife can't enjoy it with me in the car? :? Do they want me to buy it again for use in my home movie, which makes me no money? :evil: Maybe I'll start using music from bands less popular, so they will love the fact they get some exposure. Larz is a whining putz!

Using copyrighted music with videos or slide shows is a subject that has been on professional photographers' forums for years. As a professional photographer, I provide slide shows (and an occasional video) to wedding and portrait clients. The use of music with slide shows or videos is call "synchronization."

I belong to a relatively large professional wedding photographer group that has tried for years to get the major music labels to license us "sync" rights for these types of uses.

It comes down to a handful of musicians and singing artists that don't want THEIR copyrighted performance to be associated with anything they don't personally approve. Sometimes they want big $$$ (think $50K and up) and sometimes no amount of money (think political ads) will get their permission. Therefore, the major music labels license very few works at decent prices.

The music labels have decided to stop going after the little guy like before and now are applying pressure to the Internet providers to enforce their copyrights by forcing them to remove any videos or slide shows using copyrighted music without prior permission.

What we do for anything that can end up on the Internet is to use "royalty free" music or find a local band or singer to provide music in exchange for a reasonable amount of $$$ or other services. Sometimes you can contact the performer and get permission for a video... if he/she/they have an interest in your hobby or work.

All these people have different copyrights on a piece of music you hear:

- whoever wrote the tune.
- whoever wrote the words.
- whoever performed the tune/words.

The first two groups are easy to license rights, it is the third group that is difficult. Even then just about anyone can license the rights to manufacture and sell DVDs of music (all 3 of above), but.... as soon as it is used with a video or slide show it is a whole new ballgame.

Yep it's a shame. I kind of want to jump into the "screw 'em" camp but I have this darn conscience thing. I think for any future videos I'm going to use the royalty free stuff. I've used several songs from this site: http://freeplaymusic.com/ Some of it's pretty doggone good. Let's you download free mp3's or AAC (iTunes) of the music. No singing, just music.

Edit: Looks like there is a licensing fee if the song is used on the Internet. I sent an email asking for clarification on using the music the way it is used here: for personal entertainment but shared with the general public, a la Vimeo.

I got drawn in on another thread about this same post, ergo I'll not raise my hand and get it stepped on again. But this is what I do for my music. The company was Sound Forge, the software is Acid. They have since been bought out by Sony. This is the only address I have for them. [email protected]. I don't know how much the software is now, but the disks run from $20.00 to$45.00, and that includes the licensing, and any use forever, as much as you want. For most of you it will probably be more than you want to spend, but you actually create your own sound tracts. It's very creative and I enjoy piecing the clips together, it is pretty much like assembling a jigsaw puzzle. Sony has a place that you can down load a sample of each CD. And the folks from the freeplaymusic.com website responded to my email. Bottom line is you can listen to their music all you want for free but as soon as you use it in a home video, or on a website, there is a $25 per title per URL per year licensing fee. Meh. Nevermind.
