I think their main concern was that everybody paid their own way with no free rides.
I dunno if FAA backed off or not, but a situation like at Indy would seem to be ideal.
You own the land, it's separate from the airport,
and you have no financial or legal obligations to maintain the airport.
Airports with “Through the fence” were grandfathered in on airports which accept federal AIP funds, but no new ones will be permitted.
But, if Independence hasn’t taken federal funds, that policy doesn’t apply.
Whee is right: Ideal would be owning your own airstrip. That comes with other issues, though, generally referred to as “neighbors”.
How airports manage leases varies from state to state. Here, leases are renewable. In Alaska, the lease period varied, based on value of improvements, but at end of lease, State owned your building. That would suck. Also makes it hard to get loans, etc.
