Reprecussions

Let's say u where flying home from work last Friday and you were a stupid incompentet moron of a pilot and you didn't realize how much more fuel your new prop made u burn. #-o So you're forced to land in the near dark and barely missed a fence and lucked out and also missed the large rocks on the hill near a complete stranger's house. Let's say you knock on the door but no one is home. It's dark and you don't know where u are exactly and have no cell service so you start walking. A couple miles later u get to a paved road. A truck stops after you walk a little further and four guys offer u a ride with the driver warning as you as he gasses it (u riding in the bed of the truck) "hang on I'm pretty drunk! Want a beer?" So a couple miles and a beer later, u get cell service and call the wife (who's very happy to hear the story :^o ) so she heads your way and picks you up from the drunk guys (now parked on the side of the road and asking u if u will give them a ride tomorrow once u get some gas for your plane since they gave u a ride)

So, u call the sheriff and let them know someone may call to complain about a plane parked 75' from their back door and they say ok. Then the next morning u head back with some gas cans only to find the (open last night) gate at the end of a very long driveway is closed and locked. So u tell
the wife to wait while u hop the fence and walk with the cans up to the house. The man who
opens the door doesn't seem too happy to see u. U explain in your friendliest, sheepish way that u
had to land at his secluded house and didn't really have a choice. He wants to know why u didn't
call him last night or call the sheriff. U tell him u did call the sheriff but u didn't know his name or
how to reach him. He says the sheriff didn't know anything about it and he thought in might be a
drug runner's plane and that he has called the sheriff, state patrol, CBI, FBI, and maybe someone
else u can't remember. U cuss a lot on the inside while smiling and saying u understand his concern
on the outside. Luckly u both agree that he doesn't want a plane on his property and since there's a
good two hundred feet of crooked two track running down the hill you dump in the gas and twenty
minutes later you're home.

So, if this kind of hypothetical situation were to happen to any of u, what would u do about the CBI FBI thing? ( let's say he made sure to tell u that he included your tail number in the reports)

Glad your friend is ok, sounds like a hellva story!

Fill out a NASA form asap stating that perhaps the fuel gauge was "stuck" and the forced landing caused the gauge to "unstick". :?:

Go to the ASRS site, and file a form with NASA, here: http://www.asrs.arc.nasa.gov/report/electronic.html .

That constitutes a "get out of jail free" card with the FAA. I seriously doubt that TSA or the FBI are going to give you any grief, short of maybe a phone call. They have probably already called the FAA, though.

File an ASRS form within ten days of the incident, and the incident has to have been "inadvertent"

Oh, and the less he says the better! With the property owner mentioning "drug running" to anyone, I'd expect a phone call/letter from the FAA. Hopefully once they find out no contraband was involved, they'll file a report and that'll be that.

ASRS won't do any good. Running out of gas is not accidental or inadvertent. When the FAA calls simply say you did no such thing. What proof do they have?

What do you think they can do? Cite you for a precautionary emergency landing (you didn't say he said he ran out of gas)? If the property owner didn't charge you for trespassing you're home free. If the FBI CBI (what's CBI?) call you just tell them you gave the property owner all the drugs and he stashed them behind his drywall in his house. :D

I'd have taken off and flown home, period. The next day the property owner where I landed would get a nice big, and maybe framed, aerial pic of his property, along with a 25 buck gift certificate for the nearest resturant to buy him lunch. The landing was precautionary, something sounded funny, I had plenty of gas :shock:

Keep in mind, folks, that the original post is a hypothetical scenario intended to get us thinking and prepared for such an outcome. Blu, good on you for using your creative mind to generate such a wild scenario. I would elaborate on the good old boys in the pickup more though, that seemed like a good element to the story.

Dont say shit about the gas. Say it was a precautionary landing (engine running, could have sounded rough, Oil temp? ) and waited until morning to take off.

Might be that the landowner took some pictures so hopefully your friend won't be inclined to get creative if asked to recount the event. All they have to use against this friend is what he tells them.

Who's gonna say anything?

Private property. No damage. No law enforcement on scene to manage traffic or take a report. Airplane and pilot are gone, and tucked into hangar at home. Is ANY agency going to waste time/money doing an investigation of something like this?

Of course it was carb ice, no idiot in his right mind would run out of fuel [-X

I'll bet this all blows over and your 'buddy' has the best story of 2010 to recount. I wanna meet him and hear about his dream firsthand. :wink:

BS...

You CAN run out of gas inadvertenly. Winds aloft forecast inaccurate, blah, blah, blah....lots of ways to do this inadvertantly. Not smart, but....not a felony either. The FAR requires that you DEPART with enough fuel to go the distance and arrive with a 30 minute reserve during daylight VFR. Once you are enroute, there is no rule, except don't run out of gas and hurt someone. File the report.
