Any BCP California Lawyers?

By chance do we have any California lawyers on here? I'm in need of one. Please PM me.

Thanks,
Cory

Sigh...I've got some guys trying to back out of a deal to purchase an aircraft after an agreement was in place.

Always get a non refundable deposit. Then when a buyer tries this stunt you get paid for your time and trouble. CYA

Re: Any BCP California Lawyers?

I knew eight or ten California lawyers, but some guy flew in from Oregon in a Maule and shot them all.

Then he tried to send us a bill for services rendered.

Re: Any BCP California Lawyers?

Any copies of e-mail correspondence that would constitute verifyable verbal agreement?

Yup. Lots of them. Got an email a while ago. For now it looks like they are going to honor their agreement. Fingers crossed.

Glad to hear it. Hope it works out.

I do wonder from a legal (not ethical) standpoint: How enforceable is any of this stuff until a written contract is signed or money changes hands? A person can't decide that they don't want to sell?

Re: Any BCP California Lawyers?

I'm no lawyer but from what I've been told and read, once they've agreed to terms it is binding. In this case it wasn't a matter of not wanting to sell, but wanting to sell to someone else for more money after making an agreement with me.

Yeah, I'm definitely not defending them or their reasons. Just surprised that it would be so enforceable.

Maybe I'm wrong though and their reasons do matter? Maybe the law would frown on "got a better offer" but be ok with "I just decided I couldn't bear to part with it"?

Dunno, maybe one of the lawyers will chime in.

Re: Any BCP California Lawyers?

My understanding is that a vebal agreement is just as enforseable as a written agreement in my state, but may be harder to prove. E-mail correspondence would constitute written agreement.
