I think that Kevbert has given very good guidance in this matter. If you make an enemy or embarrass anyone they will look for ways to close the strip.

Re: Chicken Strip

From the RAF web site:

"John Kounis provided the RAF and NPS photographs of the airstrip that revealed only minimal damage that could be repaired with a work party employing a small number of volunteers. After receiving the RAF photographs, Death Valley National Park Superintendent Sarah Craighead and Chief Ranger Pennington reaffirmed their commitment to reopen the airstrip as soon as possible. "

John Kounis if you can hear this is any of this true??? Do you have pictures? Boy would I like to see that.

Tomorrow I will explain to Mr. Pennington how stupid (pink for embarrassed) I felt driving out there to evaluate the damage and get an idea of how much manpower would be required to do the repairs.

Just think of this. I was so stooopid I took a tape measure and a sketch book and a camera to aid my evaluation. This guy is really a moron. I believed these people. I want to hide under a rock...

Re: Chicken Strip

I flew my 182 into the Taildragger strip along time ago. 2 Bicycles, coolers and camping gear. Had a great time. Used the Chicken Strip many times. Closing the Chicken strip would be a loss. Before good cell service, I was there and one of the campers family members was sick on the outside of the valley, I relayed the com message and an aircraft flew into the Chicken strip to pick them up and fly them out to be with their family. Do nothing politicians, sabotaging lizzards, make me sick.

Re: Chicken Strip

Hope I did not over step my bounds, I sent this to the RAF on our behalf.

Last week we started a list of members of the BCP “Back Country Pilots” that were interested in the political support and maintenance of the airstrips in the south west, Kennedy Meadow, Tunnel Meadow, Templeton Meadow, Monache Meadow and others. We are using Rick Loch Kernville airport manager L05 as the coordinator, so far we have a list of approximately twenty volunteers from the BCP and the number is growing. Please contact Rick so that he can notify BCP volunteers when we can get a date to repair the chicken strip. e-mail Rick, [email protected] or call Rick at 760-378-3870. If He’s not at the airport please leave a message and He will get back to you. I believe that I am speaking for all of us when I tell you that we are all in support of the RAF and their efforts to restore and preserve our recreational airstrips.

Re: Chicken Strip

Well... I talked to Brent (chief ranger) for an hour this morning. I think we are dead. Anyway he said he would ask (ask?) Lizard Lee to please please remove the Suzuli and the drag from the runway but I suspect even that won't happen. I hope someone else has better luck that I did. He said he needs a legal opinion from the NPS solicitor. He said he had on idea how long that would take. In his words "This is a very low priority item". In case you missed it the first time. Low priority.....We are dead. :(
This is a screwed up mess. I left a message for Sara Craighead but no reply yet.

Re: Chicken Strip

So...... do you think there's a possibility that the same issues can happen with the other strips mentioned in the following thread?? http://www.backcountrypilot.org/forum/viewtopic.php?f=20&t=8490

If so, I think I'm going to take a back seat on this one. I would love to volunteer my time and back breaking work. But, I'm having a bad feeling about this just from the Chicken Strip ordeal! Shoot, I was thinking it would be great to help out down there this fall/winter since I'm hardly never home during the spring/summer to help out with work parties up here in Idaho.

Anyway, I try to keep positive about this and I'll follow along with what's happening.

BTW...... why the hell does the Park Ranger feel he need's to kindly "ask" Lee to remove the truck and grader off of the government owned land??? Is Lizard Lee with or against the aviation community??

But then again, from what I understand, the Chicken Strip is an "Unofficial Airport/Airstrip". It's not even on a chart. So I guess really, the NPS can really do what they want?? Certainly would be a whole different story if it was an "Official Airport/Airstrip"??

Anyway, just my 2 cents :D :D

O.K. I just got off the phone with Sara Craighead and I got a big "Goose Egg". She was no help at all. It should be noted that she did call me. She said Brent would take care of it sometime.

She sort of said they should be able to do something "in a couple of days". Image

Re: Chicken Strip

First lets here from the RAF on this subject, we will need a list of contacts to send letters to, asking for our airstrip returned to operational condition and the vandals arrested that damaged it. One or two letters will not be enough to get results; we will need support from as many as possible, if we inundate them with letters of our concern (breaking and not supporting their agreement with the RAF)we will bring this to the public’s attention its very likely that our strip will be restored. My question is how many law suits would the Death Valley National Park Superintendent Sarah Craighead and Chief Ranger Penningtonthese like? And how famous would famous would they like to be?

Chicken Strip

What would you sue them for?

Their liability in this case lies in keeping it open.

Is there a binding agreement with the RAF to keep this strip open? I understand there was.
If there was, there has been a breach of contract with the RAF.
By restricting access to area for the disabled and elderly that could access other than by aircraft.
By encouraging and fostering public nudity in a national park. Lizard Lee and friends
By supplying and fostering Lizard lee the tools (the drag and truck) to damage NPS property (runway).
If so then, misappropriation of NPS equipment.
By lying about the true condition of the runway to restrict access of public lands. Question is will they lie under oath? Or only to the public? News stories love this stuff.
Generally speaking not many people like giving sworn affidavits or getting served, for Lee that’s a trip to town to talk to an attorney how many times would it take to change his tune. I suspect if Lizard Lee got served the NPS would run the other way dropping him like a hot potato.
If there is no proof that there was storm damage, and there is evidence that the runway was damaged intentionally to restrict public access using NPS equipment with the manger approval even after there has been an agreement to preserve it?
I know, most is hot air/rant, political pressure through the RAF is still our best tool.

What is there lilability in keeping it open? How dose it differ from a road or 4X4 trail?

I believe that you understand wrongly. I guess our RAF rep can answer definitively but the government doesn't often sign "binding agreements" of this sort short of actual procurement contracts and the like. It is my understanding that it was simply an agreement that would allow the RAF to perform maintenance and did as much to protect the RAF from liability as anything. I will put myself out there and guess it mentioned nothing about "protecting access" whatsoever.

By restricting access to area for the disabled and elderly that could access other than by aircraft.
Nonstarter.
By encouraging and fostering public nudity in a national park. Lizard Lee and friends
Nudity is not against regulations per se.
By supplying and fostering Lizard lee the tools (the drag and truck) to damage NPS property (runway).

One man's restricted access is another's resource protection. Have you read this whole thread?

You can't appropriately personally serve a NPS employee or volunteer with a lawsuit related to their official duties.

They can be sued by alphabet groups for allowing aircraft use that is contrary to regulation, policy, and arguably (though not by me), public law.

Re: Chicken Strip

"Nudity is not against regulations per se."
2nd time I went to CS I was treated to the sight of a chunky 30y/o woman and her 4y/o son both nude, different strokes for different folks but I think nude children belong in a bath tub in a discrete location not in a public National Park. Vandalizing an airstrip that might be needed is quite a step above nudity, but if we as pilots displayed as much disregard for rules and laws what would we be facing stiff penalty's I'm sure.

Here's some easy reading,

Federal Land
There is no Federal law against nudity but neither is it a guaranteed right. This means that state, county and local laws can take precedence.
California State Law

CALIFORNIA CODES SECTION 314-318.6 (as of 6/2000): Every person who willfully and lewdly, either: 1. Exposes his person, or the private parts thereof, in any public place, or in any place where there are present other persons to be offended or annoyed thereby; or, 2. Procures, counsels, or assists any person so to expose himself or take part in any model artist exhibition, or to make any other exhibition of himself to public view, or the view of any number of persons, such as is offensive to decency, or is adapted to excite to or thoughts or acts, is guilty of a misdemeanor.

Re: Chicken Strip

I was hoping to hear from the RAF re. their conversation with Brent this morning.

Plus I hope Sara Craighead is reading this because tomorrow I am mailing a letter to Jonathan Jarvis regarding your con·de·scend·ing attitude toward me and users of the Chicken Strip during our telephone conversation this morning. In case you are unfamiliar with the term con·de·scend·ing it means acting in a way that betrays a feeling of patronizing superiority. In case you don't know who Mr. Jarvis is well... you'll probably figure it out. Maybe next time you will have a little more time for a park user / taxpayer / pilot. A little less attitude next time please.

BTW if anyone wants to send JJ a letter his address is:

Thanks for the def. Glidergeek.

How about a National Park volunteer living in a Cr.. Hole inside a National Park. O.K. I think the Cr.. Hole thing was over the top.

I think I may be developing a bad attitude about this whole problem.

Re: Chicken Strip

Desert Rat did good work today! A reasoned but persistent voice was how the conversations were described. We (the RAF) have too been in several conversations today and can only give an educated guess that this will be resolved shortly.

Too much pressure from too many of us today would have done damage. As it is, it was perfect. The NPS fully "gets it" that there are a whole bunch of folks just like DR that will keep them real busy for a while if they do not resolve this quickly.

Please understand that my comments are a bit "guarded" until we get this done. I would not want a copy and paste comment taken out of context and offend someone unofficially trying to help.

The next 48 hours will be interesting.

Thanks to Desert Rat (who may need to be renamed Wiley Fox) and everyone else for the great discussion, opinion and suggestions. It is now up to the NPS to do then"right" thing.

Like I said mostly hot air I will admit I was caught up in the moment, I even said it was a rant.
I never intend to imply that the RAF had an agreement for “protecting access” to this strip, however I was under the impression that we had an agreement to maintain and use it, why would we volunteer to maintain it if we can’t use it?
I did intend to make the point that by closing the strip it would limit access to elderly and disabled that once had access to the springs via the airstrip.
I may have missed part of this thread everything that I read about the closure was vague.
If Lizard Lee an employee or volunteer of the NPS was he performing his duties when he destroyed the strip? Or is he acting on his own? Would he be liable then?
Please define alphabet groups? FBI,CIA? I can think of many. Including ones associated with and against 4X4 and dirt bikes, guns, horses, dogs, dog owners, aircraft, aircraft owners, need I go on.
How is keeping this strip open contrary or against who’s policy, regulation, or public law? And what are they? I /we need to know.
Have we been using this strip illegally in the past? And if so what law or policy are we breaking? If we rebuild this runway and use it, will we be in violation of code, policy, regulation or public law?

His responce

The Chicken Strip is closed for now due to severe flood damage from last
week. We are working through some legal concerns through our regional and
national aviation staff regarding an existing maintenance agreement with
the Recreational Aviation Foundation (RAF). Should have more information
later in the week or early next week. The park is getting ready to start
on a Management Plan for the Saline Valley area that will determine in the
long term what happens with the Chicken Strip. There will be many
opportunities for public involvement in that process. But for the shortMr Pennington:

Thanks for your responce but it looks like your statement about severe flood damage may be a bit exagerated. I think that maybe you just heard that it was severe from the person that put the white X on the strip to close it.

It a looks like one of your volunteers took it upon himself to close the strip because he just does not think that pilots should have access to that part of the world. My report came to me second hand so I am thinking of driving down in November to see this severe damage for myself. Whould it be OK to volunteer to remove the white X while I am there. Probably too much work for one old guy but I think that there are about 20 of us that can get the job done.

Please advise.
